Local and State Open Burning Regulations

Open burning is regulated by both the Ohio Environmental Protection Agency (EPA) and our local and state fire codes to protect public health and air quality. In Mansfield, certain types of open burning are restricted or prohibited due to safety and environmental concerns.

  • Burning of household waste, yard debris, or construction materials.
  • Certain types of open burning within city limits without proper authorization.
  • Fires that create excessive smoke, odors, or pose a nuisance or hazard to neighboring properties.
  • Burning during air pollution alerts or dry conditions that increase fire risk.

Certain agricultural and controlled burns may require approval from the Ohio EPA and the Mansfield Fire Department before ignition.

Recreational fires, such as campfires and outdoor fire pits, are allowed under specific conditions:

  • Fires must be contained in a fire pit, chiminea, or manufactured outdoor fireplace.
  • Fire size must not exceed 3 feet in diameter and 2 feet in height.
  • Fires must be at least 25 feet from structures, fences, or combustible materials.
  • Only clean, dry firewood may be burned (no leaves, trash, or treated lumber).
  • A responsible adult must be present at all times with a means to extinguish the fire (such as a hose or extinguisher).
  • Fires must be fully extinguished before being left unattended.

If a fire is producing excessive smoke or causing a nuisance, it may be required to be extinguished, even if it meets all other guidelines.

Fire Department Investigation of Burn Complaints and Penalties

The Mansfield Fire Department investigates reports of illegal burning. If a fire is found to be in violation of local or state regulations:

  • Firefighters may order the fire to be extinguished immediately.
  • Repeat violations or fires that pose a hazard may result in citations or fines.
  • In some cases, violations may be referred to the Ohio EPA for further enforcement.
